Terms of Service

1. Eligibility

• You must be at least 18 years of age to use the Platform.
• By using the Platform, you represent that you have the legal capacity to enter into these Terms.
• If you are using the Platform on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.

2. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account.
• One person may create multiple profiles under a single account for different businesses or roles.
• We reserve the right to suspend or terminate accounts that violate these Terms.

3. Platform Services

Boostify provides the following services:

• Digital Business Cards — create and share digital profiles with contact information, social links, QR codes, and custom sections
• Analytics — track profile views, link clicks, and visitor engagement
• Commerce Features — display products/services with WhatsApp-based Buy and Enquire buttons
• Team Management — multi-profile support, staff roles, and permissions

4. Acceptable Use

You agree NOT to use the Platform to:

• Upload or display illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable content
• Impersonate any person or entity, or misrepresent your affiliation with a person or entity
• Engage in fraud, phishing, or deceptive practices
• Distribute spam, unsolicited messages, or malware
• Attempt to gain unauthorized access to other accounts, systems, or networks
• Scrape, crawl, or use automated tools to extract data from the Platform without written permission
• Interfere with or disrupt the Platform or its infrastructure
• Violate any applicable law, regulation, or third-party rights (including intellectual property rights)
• Use the Platform to promote illegal activities, hate speech, or discrimination
• Upload content that infringes on copyrights, trademarks, or other intellectual property

We reserve the right to remove content and suspend or terminate accounts that violate these guidelines, without prior notice.

5. User Content

• Ownership: You retain ownership of all content you create and upload to the Platform (profile data, images, text, designs).
• License to Us: By uploading content, you grant Boostify a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute your content solely for the purpose of operating and providing the Platform services.
• Public Profiles: Content on published profiles is publicly accessible. You are solely responsible for the content you choose to make public.
• Removal: You can delete your content at any time. Deleted content will be removed from our servers within 30 days, except where retention is required by law.

6. Templates & Designs

• Templates provided by Boostify are licensed for your personal and commercial use based on your subscription plan.
• Free plan users may use free templates. Premium templates require an active paid subscription.
• You may not redistribute, resell, or sublicense Boostify templates as standalone assets.
• Designs you create using our templates are yours to use without restriction.

7. Subscriptions & Payments

• Boostify offers free and paid subscription plans. Paid plans are billed on a recurring basis (monthly or annual) as specified at the time of purchase.
• All payments are processed securely through Razorpay. We do not store your credit/debit card or bank details.
• Prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise.
• Subscriptions auto-renew at the end of each billing period unless cancelled before the renewal date.
• You can cancel your subscription at any time from your account settings. Access continues until the end of the current billing period.
• We reserve the right to change pricing with at least 30 days' prior notice. Price changes apply from the next billing cycle.
• Refunds are governed by our Refund & Cancellation Policy.

8. Free Plan Limitations

The free plan provides access to core features with certain limitations (e.g., number of profiles, templates, storage). Free plan features may change at our discretion. We may display advertisements to free plan users via Google AdSense (web) and Google AdMob (mobile).

9. Intellectual Property

• The Boostify name, logo, website design, application code, templates, and all related intellectual property are owned by Boostify and protected under applicable intellectual property laws.
• You may not copy, modify, distribute, or reverse-engineer any part of the Platform without written permission.
• All trademarks, service marks, and trade names used on the Platform are the property of their respective owners.

10. Third-Party Services

The Platform integrates with third-party services including Google OAuth, Razorpay, Cloudflare R2, Google AdMob, and Google AdSense. Your use of these services is subject to their respective terms and privacy policies. Boostify is not responsible for the practices or availability of third-party services.

11. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Platform will be uninterrupted, error-free, or secure
• Any defects will be corrected within a specific timeframe
• The Platform will meet your specific requirements
• Results obtained from the Platform will be accurate or reliable

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BOOSTIFY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM.

Our total liability for any claim arising from these Terms or your use of the Platform shall not exceed the amount you paid to Boostify in the 12 months preceding the claim, or INR 1,000, whichever is greater.

13. Indemnification

You agree to indemnify and hold Boostify harmless from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of the Platform, your violation of these Terms, or your violation of any third-party rights.

14. Termination

• You may terminate your account at any time by contacting us at support@boostify.biz.
• We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or upon legal requirement.
• Upon termination, your right to use the Platform ceases immediately. Your data will be handled as described in our Privacy Policy.
• Sections that by their nature should survive termination (including intellectual property, limitation of liability, indemnification, and governing law) will survive.

15. Modifications to Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date and notify you via email or in-app notification. Your continued use of the Platform after changes constitutes acceptance of the updated Terms. If you disagree with the changes, you must stop using the Platform.

16. Governing Law & Dispute Resolution

• These Terms are governed by the laws of India.
• Any disputes arising from these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts in Tiruppur, Tamil Nadu, India.
• Before initiating legal proceedings, both parties agree to attempt to resolve disputes amicably through negotiation within 30 days of written notice.

17. General Provisions

• Entire Agreement: These Terms, along with the Privacy Policy and Refund & Cancellation Policy, constitute the entire agreement between you and Boostify.
• Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.
• Waiver: Failure to enforce any provision shall not constitute a waiver of that provision.
• Assignment: You may not assign your rights under these Terms. Boostify may assign its rights and obligations without restriction.
